Covenant Violation Policy

 

 

Dear Wakefield West Homeowner:

 

We want to inform all the homeowners of the notification process we intend to follow in instances of covenant violations.  These are some of the common violations of which we are aware:

                       Siding missing

                       Breeding of dogs

                       Items in driveway for extended periods of time; Boats, Portable storage units (P.O.D.S., etc.)

                       Basketball goals blocking sidewalks

                       Poor lawn care, including failure to fertilize or mow (mainly in spring/summer)

                       Unpaid dues

 

Here is the process we will follow:

 

1. As a board, we remain open and willing to work with any Wakefield West homeowner who needs an extended time in order to adequately correct a situation.  However, in order for an agreement to take place, a homeowner must initiate contact with us.

2. If we must address a covenant violation we will send a letter, via standard mail, to the homeowner in violation.  This letter will state the violation as well as serve as an official seven-day (business days) notice to rectify the situation.  If the homeowner contacts the board within the 7-day window, we will be glad to work out a plan if more than 7 days is needed.

3. If there is no response after the initial 7 days then a second letter will be mailed, also via certified mail.  This letter will reiterate the problem and extend another 7-day window to remedy the problem.

4. After the 2nd letter and the completion of the second 7-day period, we will make the problem known to our lawyer, at which point the homeowner will be responsible for any legal fees associated with remedying the situation, which may include court costs.  Any legal fees will be the responsibility of the homeowner.

 

We hope that we all, as homeowners living in community with one another, may willingly uphold the commitment we made by accepting the covenants of our association.  The last thing we want to do is to pursue legal means with any of our neighbors.

Meeting Minutes


May 4, 2010

WWHOA Monthly Board Meeting

 

Present: Bobby, Maria, Eric, Jennifer S, Roy

Absent: Billy, Jennifer B

 

1.      Bobby appointed Eric to forward non-payment of dues homeowners to our lawyer.

2.      Bobby appointed Maria to be the liaison between the board and homeowners who need assistance with their dues payment.  She will be empowered to set up payments plans or extensions depending on the situation.

3.      Bids received:

a.       Billy submitted a drawing and bid for landscaping around picnic area.  We budgeted $3,500 and the bid is $3,250.  Roy will get one more bid for comparison.

b.      Billy submitted a bid for mulching the playground for $700.  Roy will get one more bid.  The playground mulch is a special child-safe mulch.

c.       Billy submitted a bid for painting the picnic shelter for $600.  Decided to hold a painting party rather than hire to have it done.  Should be done before the landscaping job.  Date to be set.  Bobby will advertise on Facebook.

4.      Discussion about stop signs.

a.       Decided not to ask county to remove trees by the signs on Wakefield Rd and Fairfax.

b.      Decided not to request a stop sign by Columbia Cir.

c.       Bobby will contact Carl about asking the county to paint stop stripes at stop signs.

5.      Discussion about pond and park signs:

a.       WWHOA is getting bids for park signs.  Bobby will ask them to include a sign for our park in the bid.

b.      We will have pond signs made stating that fishing is for residents only.

c.       Bobby will speak with the man (Greg) who lives north of WW about some signs by the creek to prevent kids from damning up the creek.

6.      Roy brought up some architectural issues… fences, decks.

7.      We are waiting until summer to pay WWHOA a portion of upgrades expenses (entry walls, walkway) until we know what our project final costs will be.
